uBar Cloud Terms

These terms are between you and Brawer Canada Inc. ("we", "us") and apply to your uBar Cloud subscription. The uBar End-User License Agreement governs the uBar software. These terms govern uBar Cloud, and where the two conflict on anything about uBar Cloud, these terms apply.

1. The service

uBar Cloud is a hosted service that processes Command requests for you, as an alternative to running Command on your Mac or with your own API key. It requires a valid uBar license. Your subscription is linked to your license key and carries over when you upgrade to a new major version of uBar.

2. Subscription and billing

uBar Cloud is billed monthly or annually at the price shown at checkout. It renews automatically until you cancel. You can cancel at any time, and you'll keep access until the end of the period you've paid for. Payments and refunds are handled by Paddle under its buyer terms.

3. Included usage

Each month of your subscription, including on annual plans, comes with a usage allowance. When you reach it, [Cloud requests pause until your next monthly period begins / or describe your chosen behavior]. You can keep using Command in the meantime on your Mac, where supported, or with your own API key.

4. Changes to the service

To keep uBar Cloud working well, we may change the AI models behind it, its features, or the included usage. We'll give you at least 30 days' notice of any price change, which takes effect at your next renewal. If you don't agree to a change, you can cancel before it takes effect.

5. Acceptable use

uBar Cloud may only be used through the uBar app. You agree not to:

  • share your license key, or use it to access uBar Cloud from other software, scripts, or services;
  • resell or redistribute access to uBar Cloud;
  • attempt to get around usage limits or security measures, or to reverse engineer the service;
  • use uBar Cloud for anything unlawful, or to create content that harms, harasses, or deceives others.

6. Suspension and termination

We may suspend or end your access to uBar Cloud if you break these terms. If we discontinue uBar Cloud, or end your subscription for any reason other than a breach, we'll refund the unused portion of any prepaid period.

7. Availability

We work to keep uBar Cloud fast and reliable, but we don't guarantee that it will always be available or error-free. It may occasionally be unavailable for maintenance or because of issues with our providers.

8. AI output and actions

uBar Cloud uses AI models, which can produce output that is inaccurate, incomplete, or unexpected. Actions Command takes, such as opening a website, may not always match what you intended. You're responsible for reviewing output and for the actions you ask Command to perform.

9. Privacy

How we handle your data is described in our Privacy Policy. In short, we don't store the content of your Command requests or their responses. We keep only what we need to run and bill the service, such as your license key and usage totals.

10. Disclaimer and limitation of liability

To the extent permitted by law, uBar Cloud is provided "as is", without warranties of any kind. Our total liability to you for any claim relating to uBar Cloud is limited to the amount you paid for uBar Cloud in the 12 months before the claim arose. Nothing in these terms limits any rights you have under consumer protection laws that can't be excluded by contract.

11. Changes to these terms

We may update these terms from time to time. If we make a material change, we'll notify you by email or in uBar before it takes effect. If you keep using uBar Cloud after the change takes effect, you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Province of Ontario, Canada, consistent with the uBar End-User License Agreement.
